Cyber Society of India (CySI) organized a panel discussion on Section 65B of Indian Evidence Act on 20 May 2023 at Anna Centenary Library, Kotturpuram, Chennai, Tamil Nadu.
This provision is important in the digital age as it relates to access to electronic evidence in Legal proceedings.The Cheif Guest and Panel Head Dr. A.Thiyagarajan – Senior Advocate – Madras High Court set the context for Section 65B of the Indian Evidence Act, 1872 to address the widespread use of electronic records and the conditions and procedures for production of electronic evidence in court to ensure its authenticity and reliability asked Panelists to talk on user, Technical, Legal and overall perspective.
I spoke on the Technical aspects of Indian Evidence Act, Section 65B covering the Effect of digital technologies in current context, interpretation of definitions related to electronic data, computer output with appropriate examples and various scenarios constituing as single computer, and the recent CERT-IN directive on security incident reporting, emphasis on intrusion monitoring and logs retention for analysis & forensics prupose.
